The Montgomery County Texas Sheriff's Office say Marks, facing three "pending murder charges", has escaped from a private prisoner transport in Conroe, Texas, and is considered "extremely risky".

The prisoner transfer van stopped at a McDonald's north of Houston for a quick breakfast Sunday morning.

Of note is the mention of murder charges, which is the first official indication that Marks may be a suspect in the deaths of Scott and Swearingin. Scott and her friend Michael Swearingin were found dead in Oklahoma on Jan 15. He was last seen wearing an orange jumpsuit and restraints. 264th District Court Judge Paul LePak in Bell County denied her request.

TV station KCEN reported that Marks was arrested in MI last month on a charge alleging he broke into the Temple, Texas, home of an ex-girlfriend, Jenna Scott, on August 21.

Authorities said Marks was "extremely dangerous" and requested anyone who saw him while on the run to immediately call the police emergency number, 911.

Cedric Joseph Marks, 44, was taken into custody after an "exhausting 9 hour manhunt" involving multiple local and federal agencies, the Montgomery County Sheriff's Office wrote on Facebook.

Another Marks ex-girlfriend, April Pease, the mother of his child, disappeared in 2009 in Minnesota.

According to The Washington Post, it was unclear how Marks escaped from the private transport van, which held ten prisoners and two guards. She went missing in March 2009 while living in a women's shelter in Bloomington, and Marks got custody of their son.

Ginell McDonough (left), 37, who is Marks' wife and the mother of two of his two children, is jailed in Muskegon County, Michigan, on an obstruction of justice charge.

Maya Maxwell is charged with evidence tampering and is jailed in Bell County, Texas, on US$150,000 (NZ217,000) bond.

Maxwell had been in the Muskegon County Jail in MI since her January 11 arrest. According to an arrest affidavit, she told detectives that she drove Swearingin's vehicle to Austin in an attempt to hide it from investigators. His last fight was in September.
